Terms of Service
Effective Date: April 26, 2026
These Terms of Service govern your access to and use of ProductStudio, including our website, AI image tools, AI video tools, marketing copy tools, workflow features, dashboard, credits, subscriptions, and related services.
By accessing or using ProductStudio, you agree to these Terms. If you do not agree, do not use the Service.
1. Service Overview
ProductStudio provides AI-powered tools for ecommerce sellers and teams to create product images, remove or edit image elements, generate product backgrounds, produce short marketing videos, draft marketing copy, analyze product materials, and manage generation workflows.
The Service may include free features, paid credit packs, subscription plans, beta features, and integrations with third-party services.
2. Eligibility and Accounts
- You must be at least 18 years old or the age of majority in your jurisdiction.
- You must provide accurate account information and keep it current.
- You are responsible for all activity under your account and for keeping credentials confidential.
- You may not share, sell, transfer, or misuse account access unless we expressly allow it.
- We may require email verification or additional checks before enabling certain features.
3. User Content, Inputs, and Outputs
You retain ownership of images, prompts, product information, listings, masks, files, and other materials you submit to ProductStudio. You grant ProductStudio a limited, worldwide, non-exclusive license to host, process, reproduce, transform, transmit, and display that content solely as needed to provide, secure, support, and improve the Service.
Subject to these Terms, you may use generated outputs for commercial ecommerce and marketing purposes. You are responsible for reviewing outputs before publication and for ensuring that your inputs and outputs comply with laws, platform rules, intellectual property rights, privacy rights, advertising rules, and product claims requirements.
- AI outputs may be similar to outputs generated for other users or may contain errors, artifacts, or inaccurate claims.
- We do not guarantee that any output is unique, non-infringing, platform-compliant, or suitable for a specific marketplace.
- Do not upload content unless you have the rights and permissions needed to use it with ProductStudio.
4. Acceptable Use
- Do not use the Service for illegal, deceptive, harmful, abusive, or infringing activity.
- Do not upload or generate content that violates another person's intellectual property, privacy, publicity, or contractual rights.
- Do not generate misleading product claims, counterfeit listings, impersonations, fake endorsements, or content designed to evade marketplace rules.
- Do not upload sensitive personal data unless it is necessary and you have a lawful basis and permission to do so.
- Do not attempt to reverse engineer, scrape, overload, bypass rate limits, interfere with security, or access non-public parts of the Service.
- Do not resell the Service, create a competing model or dataset from the Service, or automate use in a way that harms ProductStudio or other users without written permission.
5. Payments, Subscriptions, and Credits
Paid features may be purchased through subscriptions or one-time credit packs. Pricing, included credits, billing intervals, and plan limits are shown at checkout or on the pricing page.
Stripe Checkout is the active payment provider for ProductStudio, and Creem may be used for legacy or alternative checkout flows where enabled. Payment providers process payment details under their own terms and privacy policies.
- Credits have no cash value, are not legal tender, and may not be transferred or resold.
- Credits are consumed when you run eligible AI operations. If our system records an eligible generation failure after credits were deducted, credits may be returned automatically or by support review.
- Annual plans may issue credits in scheduled installments instead of all at once, as shown in the product or billing configuration.
- Subscription cancellation stops future renewals but does not automatically refund past charges. Access generally continues until the end of the paid billing period unless otherwise stated.
- Taxes, currency conversion, bank fees, and payment-provider fees may apply and may be handled by the payment provider.
6. Refunds
Refunds are governed by our Refund Policy and applicable law. In general, used credits and successfully completed AI generations are not refundable, but billing errors, duplicate charges, unauthorized charges, and unresolved ProductStudio technical failures may qualify for review.
7. Third-Party Services
ProductStudio relies on third-party infrastructure, payment, authentication, email, analytics, storage, and AI model or media-processing services. Your use of those services may be subject to their terms, policies, outages, limitations, and regional availability.
We are not responsible for third-party services that we do not control, but we will use reasonable efforts to select and configure providers that support the operation of ProductStudio.
8. Product Changes, Availability, and Beta Features
- We may add, change, limit, suspend, or remove features, models, plans, prices, credit costs, or integrations.
- AI generation times and quality may vary based on model availability, queue length, input quality, content policies, and provider performance.
- Beta or experimental features may be unstable, may change without notice, and may not be supported in the same way as generally available features.
9. Suspension and Termination
We may suspend or terminate access if we believe you violated these Terms, created risk for ProductStudio or others, failed to pay amounts due, submitted fraudulent payment activity, or used the Service in a way that could expose us or others to harm or liability.
You may stop using the Service at any time. Certain sections of these Terms will survive termination, including payment obligations, intellectual property provisions, disclaimers, limitations of liability, indemnity, and dispute terms.
10. Disclaimers and Limitation of Liability
The Service is provided on an as-is and as-available basis. To the fullest extent permitted by law, ProductStudio disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
To the fullest extent permitted by law, ProductStudio will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages, or for loss of data, revenue, goodwill, business opportunity, or marketplace ranking.
Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount you paid to ProductStudio for the Service in the three months before the claim or USD 100, unless applicable law requires otherwise.
11. Indemnity
You will defend, indemnify, and hold harmless ProductStudio from claims, damages, liabilities, costs, and expenses arising from your inputs, outputs, product claims, marketplace use, violation of these Terms, violation of law, or infringement of third-party rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which the operator of ProductStudio is established, excluding conflict-of-law rules, unless mandatory consumer protection laws in your jurisdiction provide otherwise. Any dispute will be handled by courts with competent jurisdiction for that operator location, unless applicable law requires another forum.
13. Changes and Contact
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date, and we may provide additional notice where required.
